Many wonder how a corporate act can be filed quickly, especially in order to minimize the issuance of demands by the Commercial Boards.
Over the years of practice in the exercise of paralegal activity, Unionpar identified that there are 3 pillars that contribute to a corporate act being filed quickly: 1- legislative knowledge; 2- administrative knowledge; 3- practical knowledge. Thus, it should be noted that numerous requirements end up being issued due to lack of compliance with the legal precepts provided for in the regulations of DREI - National Department of Business Registration and Integration, an organ that is part of the Ministry of Economy, of which the country's Commercial Boards are technically subordinated, and is responsible for the services of the so-called Public Registry of Mercantile Companies and Related Activities. Thus, when the corporate acts are duly supported by legal precepts, including, where applicable, the provisions of the Brazilian Civil Code and the Companies Law, and also, duly instructed in accordance with the Regulatory Instructions issued by DREI, they result in a faster filing process with less possibility of requirements.
The above points, of course, must be supported by the effective knowledge of the administrative requirements, as well as by the practical procedural aspects, especially with regard to the correct execution of the systems provided by the Public Offices. Every corporate act delegated to UnionPAR for filing purposes, is screened by the team, whose purpose is to ascertain whether it complies with legal requirements and, therefore, to minimize the possibility of requirements and thus expedite the filing procedure.
